Secure your VMax capsule with a $1,000 reservation fee — fully refundable before production begins.
This Reservation Agreement ("Agreement") governs the placing of a reservation ("Reservation") with Capsule Homes R Us LLC, 3037 NW 82nd Avenue, Miami, FL 33122 ("Capsule Homes R Us" – CHRUS) for VMax series capsule homes ("VMax"). Please carefully read this Agreement before submitting your Reservation. By submitting your Reservation, you agree to be legally bound by all terms of this Agreement.
By this Agreement, together with your payment of the Reservation Fee, you are reserving a future purchase of your selected VMax capsules. This Agreement does not obligate you to ever purchase VMax Capsules, and it does not obligate CHRUS to ever sell you a VMax Capsule. This Agreement is not a contract for the purchase or finance of a specific VMax Capsule. It does not lock in final pricing, a firm production slot, a firm delivery date, or specific configuration of a VMax Capsule.
After you submit your Reservation and the VMax Capsule you have selected, we will invite you to complete the configuration of your VMax Capsule. Once you have completed the configuration of your desired capsule, we will provide you with confirmation of your chosen configuration, and a detailed break-down of the final price. To purchase the capsule you have selected and configured, you will need to execute a standard Purchase Agreement and make a 50% deposit of the total cost prior to production. Upon the receipt of the deposit, production shall commence.
By placing your Reservation, and thereby entering into this Agreement, you represent that you are at least 18 years of age or the legal age of majority in your state/province/territory (whichever is greater) and legally competent in the jurisdiction from which you are entering this Agreement to do so. If you are reserving a production slot for a VMax Capsule, you further represent that you have actual authority to bind such legal entity or organization to this Agreement. We reserve the right to accept or decline Reservations in our sole discretion.
You will be charged a one-time fee of $1,000 USD ("Reservation Fee") per capsule when you place your Reservation for a VMax Capsule. Placing a Reservation, which includes acceptance of this Agreement, constitutes your agreement to be charged the Reservation Fee using your provided payment method (credit card, PayPal, or check).
The Reservation Fee is not a pre-payment or installment on the VMax Capsule that you may ultimately purchase, nor does the Reservation Fee guarantee the allocation of a VMax Capsule. All capsule orders require the initial 50% deposit of the total price and final balance payment prior to the shipping of the capsule homes from its origin. Failure of payments shall result in the cancellation of reservation and the Reservation Fee being refunded as well as forfeiting the spot allocation of production.
If you execute a Sales Agreement with the 50% deposit for production but failed to make the final balance of payment, a restocking fee of 33% shall apply. The remaining balance of funds shall be refunded back to the original Payor.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: This Agreement is effective upon Capsule Homes R Us LLC's receipt of the Agreement and your payment of the Reservation Fee. Capsule Homes R Us LLC reserves the right to accept or decline this Agreement and payment of the Reservation Fee at its office in 3037 NW 82nd Avenue Miami, FL 33122. By submitting the Agreement and paying the Reservation Fee, you agree that the Agreement is formed in the state of Florida, United States.
